Terms of Service

These Terms of Service ("Terms") govern your access to and use of the ForSaleNFC website and services ("Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

The service

ForSaleNFC provides NFC-enabled buyer cards and a web dashboard that lets real estate agents share property links with buyers and manage their buyer relationships. We may add, change, or remove features at any time.

Accounts

• You must provide accurate, current information when you register and keep it up to date.
• You are responsible for maintaining the security of your account and for all activity that occurs under it.
• You must be at least 18 years old and use the Service for legitimate business purposes.

Acceptable use

You agree not to:

• Use the Service for any unlawful, misleading, or fraudulent purpose.
• Send unsolicited messages or otherwise violate applicable laws governing electronic communications, including the TCPA and CAN-SPAM.
• Interfere with, disrupt, or attempt to gain unauthorized access to the Service or its systems.
• Upload content that infringes the rights of others or that is unlawful, harmful, or objectionable.

Communications

We contact you by email about your account, orders, and service notices. ForSaleNFC does not operate an SMS messaging program and does not send automated text messages. For full details on how we handle your information, see our Privacy Policy.

Payments

Paid features and card orders are billed through our third-party payment processor. Fees are described at the point of purchase. Except where required by law, payments are non-refundable.

Intellectual property

The Service, including its software, design, and content provided by us, is owned by ForSaleNFC and protected by applicable laws. You retain ownership of the content you submit, and you grant us a limited license to use it solely to operate and provide the Service to you.

Your content and third-party listings

You are solely responsible for everything you add to the Service, including property addresses, descriptions, photographs, audio recordings, and links to third-party websites such as public listing pages or a multiple listing service ("Your Content").

You represent and warrant that you own Your Content or have obtained all rights, licenses, consents, and permissions necessary to submit it and to have it displayed to buyers through the Service, and that Your Content does not infringe or misappropriate the copyright, trademark, publicity, privacy, or other rights of any person or entity. Real estate photographs are frequently owned by the photographer or the listing broker rather than by the agent showing the property; obtaining permission is your responsibility.

You further agree that your use of the Service will comply with all rules applicable to you, including the terms of use of any third-party site you link to, the rules of any multiple listing service or association of REALTORS® of which you are a member, and any applicable IDX or listing-display requirements. ForSaleNFC does not copy, scrape, cache, or reproduce content from third-party listing sites; links you add are stored and passed through to the buyer's browser as you entered them.

Indemnification

You agree to defend, indemnify, and hold harmless ForSaleNFC and its owners, officers, employees, contractors, and agents from and against any claim, demand, suit, proceeding, loss, liability, damage, judgment, settlement, cost, or expense (including reasonable attorneys' fees and costs of defense) arising out of or relating to: (a) Your Content; (b) your breach of these Terms or of any representation or warranty you make in them; (c) your violation of any law or of the rights of any third party, including intellectual property, publicity, or privacy rights; or (d) your use of the Service.

We will notify you of any such claim and may, at our option and expense, participate in its defense with counsel of our choosing. You may not settle any claim in a way that imposes an obligation or admission on ForSaleNFC without our prior written consent. This section survives termination of your account and of these Terms.

Copyright complaints

ForSaleNFC respects the intellectual property rights of others and responds to notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act (17 U.S.C. § 512). If you believe material accessible through the Service infringes your copyright, send a written notice to our designated agent at the address below that includes: a physical or electronic signature of the copyright owner or a person authorized to act on their behalf; identification of the copyrighted work claimed to be infringed; identification of the material you say is infringing and information reasonably sufficient to let us locate it; your contact information; a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; and a statement, made under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on the copyright owner's behalf.

Designated agent: ForSaleNFC, info@forsalenfc.com. We will remove or disable access to material that is the subject of a valid notice, notify the agent who submitted it, and accept counter-notifications as provided by the DMCA. We terminate the accounts of users we determine to be repeat infringers.

Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that it will meet your specific requirements.

Limitation of liability

To the fullest extent permitted by law, ForSaleNFC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim arose.

Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Provisions that by their nature should survive termination will continue to apply.

Governing law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in Florida.

Changes to these terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Continued use of the Service after changes take effect means you accept the updated Terms.
